In the News

TORBAY - Nov 28 A class action lawsuit against the Government of Canada has been filed on behalf of residents living in the southeast area of Torbay due to contamination of the groundwater supply originating from a nearby, federally owned property where Fire Fighting Training was conducted thru the 80’s to early 2000’s.

Transport Canada conducted an Environmental Testing Program at the Contaminated Site including the Impacted Area in March 2024 that confirmed the presence of contaminants in the groundwater. Contaminated media identified on this site are: PHCs (petroleum hydrocarbons); PAHs (polycyclic aromatic hydrocarbon); Metal, metalloid, and organometallic; and PFAS (per and poly fluoroalkyl substances). These contaminants continue to migrate from the Contaminated Site.

It is argued that the Defendant failed to capture and contain the PFAS once it leached from the Contaminated Site.

The Plaintiffs state they have suffered interference with their use and enjoyment of their properties, diminution of fair market value and marketability of their properties, out of pocket costs associated with the investigation and remediation of their properties, costs associated with monitoring of their drinking water wells, as well as the inconvenience, discomfort and distress.

Liberal MP Joanne Thompson released a statement saying water testing will begin immediately in Torbay and affected residents will be the first in the country to receive an in-home treatment system.
